Form I-526E, Immigrant Petition by Regional Center Investor, is the petition an investor files with USCIS to claim EB-5 classification under INA 203(b)(5)(E) for capital pooled in an offering for which a designated regional center has already filed Form I-956F.

What it decides

The gate is filing, not approval. 8 U.S.C. 1153(b)(5)(F)(i) makes the regional center file its application for the offering before any investor petitions on that offering, and 8 U.S.C. 1154(a)(1)(H)(i) lets the investor file once that application has been filed. Clause (H)(ii) fixes eligibility as of the filing date and makes approval of the petition subject to approval of the regional center's application, so waiting for the I-956F to be approved gains nothing and costs priority date. The fee on Form G-1055 is $3,675, and an initial I-526E filed on or after 1 October 2022 carries a separate $1,000 EB-5 Integrity Fund payment, which G-1055 says does not apply to an amendment request. The same form is also how an investor reports the amendments needed to keep eligibility if the regional center, new commercial enterprise or job-creating entity is terminated or debarred. Current edition 01/20/25. One combined fee payment covering the I-526E and a concurrent I-485, I-131 or I-765 is rejected: each form needs its own.
