Form I-956H

What it decides

A person is involved, under 8 U.S.C. 1153(b)(5)(H)(v), if they hold direct or indirect substantive authority over operational or managerial decisions about pooling, securitization, investment, release, acceptance or use of program funding, which reaches principals, owners, officers, board members, managers, general partners, agents and similar roles. A person can be an organization as well as an individual. Subparagraph (H)(i) bars involvement where, among other grounds, the person was found to have committed a criminal or civil offense involving fraud or deceit within the previous 10 years, a civil offense involving fraud or deceit that produced liability in excess of $1,000,000, or a crime for which they were sentenced to more than one year, or where the person is subject to a final order, for as long as any penalty under it runs, of the Securities and Exchange Commission, a state securities commission, a state bank or credit union supervisor, a state insurance commission, a federal banking agency, the Commodity Futures Trading Commission, an SEC recognized self regulatory organization or the National Credit Union Administration, provided the order rests on a violation of a rule against fraudulent, manipulative or deceptive conduct or bars the person from the securities, insurance or banking business. Subparagraph (H)(ii) separately requires that a person involved with a regional center be a US national or lawful permanent resident and not the subject of rescission or removal proceedings, which is why a permanent resident must attach a copy of the front and back of the green card. USCIS requires the form from each person involved with a regional center, a new commercial enterprise or an affiliated job-creating entity, meaning a job-creating entity controlled, managed or owned by those people under 8 U.S.C. 1153(b)(5)(D)(i); a person involved with a job-creating entity that is not affiliated files only if the Secretary requires it. Each form goes in its own envelope or folder inside the Form I-956 or Form I-956F packet and is identified in a cover letter, never as an exhibit, or USCIS may reject the associated form. Someone who already filed with a Form I-956 files again with the Form I-956F if they are involved with the new commercial enterprise or the job-creating entity. In answer to a request for evidence or a notice of intent to deny, the form is mailed on its own to the I-956H address rather than with the response.
