USCIS Policy Manual Volume 6 Part G

The EB-5 part of the USCIS Policy Manual, titled Part G, Investors, sitting inside Volume 6, Immigrants; it runs to eight chapters and is cited as 6 USCIS-PM G.
What it decides
USCIS says the Policy Manual contains its official policies and is to be followed by all USCIS officers in the performance of their duties, that it does not remove their discretion in making adjudicatory decisions, and that it creates no substantive or procedural right or benefit legally enforceable against the United States. Part G runs from Chapter 1, Purpose and Background, to Chapter 8, Sanctions and Discretionary Determinations, covering petition eligibility, petition adjudication, regional center applications, project applications, direct and third-party promoters, and removal of conditions. It ranks below the INA and 8 CFR rather than beside them: it binds the officer, not a court, and where it conflicts with the statute or the regulation, the statute or the regulation wins. Chapter 1 flags one such gap. Because Behring Regional Center LLC v. Wolf vacated the 2019 Modernization Rule, the chapter links to the regulations in force before that rule and cites the statute instead of the regulation wherever statute has superseded it, as with the investment amount, so a reader who clicks a Part G link through to 8 CFR 204.6 can land on text that no longer governs. Part G also carries one appendix preserving Regional Center Program policy as it stood before 15 March 2022. Where a sponsor's brochure and Part G disagree about what an officer will accept, Part G is the text the officer works from.
